These Terms & Conditions ("Terms") govern your access to and use of the Magna Health Technologies website, platform, and services (together, the "Platform").
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
1. Who we are
Magna Health Technologies Limited ("Magna", "we", "us", "our") is a company registered and operating in New Zealand.
Magna operates a digital health platform that facilitates online assessments, telehealth consultations, and access to health-related services and products.
2. Nature of the services
2.1 Platform role
Magna does not provide medical advice directly.
We operate a technology platform that facilitates:
- online health assessments;
- telehealth consultations with New Zealand-registered medical practitioners;
- access to prescription and non-prescription treatments where clinically appropriate; and
- delivery of products via third-party pharmacies and logistics providers.
2.2 Practitioner relationship
When you consult with a practitioner through the Platform, you enter into a direct practitioner–patient relationship with that practitioner, not with Magna.
Practitioners:
- operate independently;
- are responsible for clinical decisions, prescribing, and standard of care; and
- comply with their professional and regulatory obligations under New Zealand law.
Magna is not responsible or liable for clinical decisions, diagnoses, prescriptions, or treatment outcomes.
3. Eligibility
To use the Platform, you must:
- be 18 years or older;
- reside in New Zealand;
- be capable of providing informed consent to medical treatment; and
- provide accurate, complete, and truthful information.
We may suspend or terminate access if information provided is inaccurate, misleading, or incomplete.
4. Medical limitations & disclaimers
- The Platform is not suitable for emergencies.
- If you experience a medical emergency, call 111 immediately.
- Online consultations may not be appropriate for all conditions.
- A practitioner may decline to provide treatment or prescribe medication at their discretion.
- Results vary between individuals. No treatment outcomes are guaranteed.
- Information provided on the Platform, including website content, educational materials, and communications from Magna staff, is for general informational purposes only and does not replace professional medical advice, diagnosis, or treatment from a qualified healthcare practitioner.
5. Prescriptions & pharmacies
- Prescriptions are issued only where a practitioner determines it is clinically appropriate.
- Magna is not a pharmacy.
- If medication is prescribed, it may be dispensed by a third-party pharmacy.
- Any contract for the supply of medication is between you and the pharmacy, not Magna.
6. Payments & subscriptions
6.1 Fees
Fees for consultations, subscriptions, and products are displayed on the Platform and are in NZD, inclusive of GST unless stated otherwise.
6.2 Subscriptions
- Some services are offered on a recurring subscription basis.
- Subscriptions renew automatically unless cancelled prior to the next billing date.
- You may cancel your subscription through your account or by contacting support.
6.3 Changes
We may update pricing or subscription terms with reasonable notice. Continued use constitutes acceptance of updated pricing.
7. Refunds
Refunds are provided only where required under the Consumer Guarantees Act 1993 or as expressly stated on the Platform.
No refunds are provided for:
- change of mind after treatment has commenced;
- prescriptions already dispensed; or
- services rendered by practitioners unless clinically declined.
Any promotional guarantees or trial offers are governed by their specific terms.
8. User obligations
You agree not to:
- misuse the Platform;
- provide false or misleading information;
- attempt to obtain prescriptions dishonestly;
- harass practitioners or staff;
- scrape, copy, or exploit Platform content; or
- use the Platform for commercial or unlawful purposes.
We may suspend or terminate accounts for breach.
9. Intellectual property
All content, branding, designs, software, and materials on the Platform are owned by or licensed to Magna.
You may not reproduce, distribute, or exploit any content without prior written consent.
10. Privacy & data
We collect and process personal and health information in accordance with:
- the Privacy Act 2020 (NZ); and
- our Privacy Policy.
You consent to the collection, use, and disclosure of your information as described in that policy.
11. Limitation of liability
To the maximum extent permitted by law:
- Magna is not liable for indirect, incidental, or consequential losses;
- Magna is not liable for practitioner conduct, clinical outcomes, or pharmacy services; and
- total liability is limited to the amount paid by you to Magna in the preceding 12 months.
Nothing in these Terms limits rights that cannot be excluded under New Zealand law.
12. Indemnity
You agree to indemnify Magna against any loss, liability, or expense arising from:
- breach of these Terms;
- misuse of the Platform; or
- inaccurate or misleading information you provide.
13. Suspension & termination
We may suspend or terminate access to the Platform at any time if:
- you breach these Terms;
- continued access poses clinical, legal, or reputational risk; or
- required by law or a practitioner.
Termination does not affect accrued rights or obligations.
14. Changes to these Terms
We may update these Terms from time to time.
The version in force at the time of your use applies.
15. Governing law
These Terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction.
